Great question. Always challenging to figure out what the "right" answer is on some of these topics (good thing most of it is "academic" in nature imo). I believe the waters have been muddied over time, on purpose. However, in this case, I personally would err on the side of the DOJ memo vs the website. While I understand what the website is saying, and they are referencing language from the source document, the memo is an "official" memo within the "system" that was semi-recently re-reviewed / re-affirmed by all parties. However, like I said in the podcast, even this approach can be tricky as the people in office at the time were not looking to strengthen / maintain the Constitution long term. They were simply eroding it piecemeal and waiting for the right time to strike. Hope this helps! God bless!
